Terms of Service
1. Who we are
Rotspit is operated by OWNER-ACTION: legal entity name, licence number and registered address ("Rotspit", "we", "us"). These terms are a contract between you and Rotspit for your use of the Rotspit app and website.
2. The service
Rotspit lets people pool money to buy a gift someone has wished for:
- A user adds an item from a supported retailer to their wishlist.
- Friends pledge an amount towards the item. Each pledge places a hold on the contributor's card. No one is charged when they pledge.
- When pledges cover the full price and every pledge is authorised on its card, Rotspit charges all pledges together.
- Rotspit then buys the item from the retailer in its own name and ships it to the recipient.
Rotspit is the seller of record to you for the gift purchase. Retailers are our suppliers; we are not their agent and they are not a party to these terms.
3. Eligibility (18+)
You must be at least 18 years old and able to enter into a binding contract to create an account, pledge or receive gifts. When you sign up you confirm that you are 18 or older. We may close accounts we believe belong to someone under 18.
4. Your account
- Give accurate information and keep your password secure. You are responsible for activity on your account.
- One person, one account. Accounts are not transferable.
- Delivery addresses you save must be ones you are allowed to share, including a recipient's address.
- You can export your data or delete your account from Settings in the app, subject to the limits in the Privacy Policy (for example while a charged gift is being delivered).
5. Pledges, card holds and the payment authorisation
When you pledge, you accept the Payment Authorisation shown in the app for that pledge. In summary:
- Hold, not charge. We place a hold for your pledge plus the service fee. The money stays in your account.
- Charge only on full funding. We charge pledges only when the full price is pledged and every pledge is authorised.
- Expired holds are never charged. Card holds expire after a few days. If a hold expires before the gift is fully funded, nothing is charged and your pledge stays in place.
- Securing round. When the gift becomes fully pledged, we place new holds on the saved card of every contributor whose hold has expired, without you being present (off-session). We notify you before each new hold and may refresh holds so they expire together.
- Retry limits and grace period. If a new hold fails or your bank asks you to confirm, we ask you to confirm in the app. We retry a limited number of times. If you do not confirm within the grace period stated in your authorisation, your pledge is released and you are not charged; the gift reopens for others.
- Maximum amount and duration. We never charge more than the total shown in your authorisation. Each authorisation has an end date after which an unfunded pledge is released.
- Price changes. We check the retailer's price before charging. If it has dropped, we charge less. If it has risen beyond what the pledges cover, we do not charge and the gift reopens for top-ups.
6. Fees and VAT
Each pledge includes a service fee shown before you confirm. Prices and fees are in UAE dirhams (AED) and include VAT where it applies. OWNER-ACTION: confirm fee schedule, VAT registration (TRN) and whether a tax invoice is issued per pledge.
7. Buying and delivering gifts
- After charging, our operations team buys the item from the retailer. Some retailers may be ordered automatically.
- Delivery estimates come from the retailer and carrier and are not guaranteed.
- If the item is out of stock, the variant is unavailable or the order cannot be placed, we refund the charged pledges in full, including fees, as described in the Refund Policy.
- The recipient's name, phone number and address are shared with the retailer and carrier to deliver the gift.
8. Cancellations and refunds
You can cancel your pledge at any time until the gift is fully pledged. After that it can only be released under the rules in section 5. Refunds, returns and fee treatment are covered by the Refund Policy, which forms part of these terms.
9. Prohibited use
- Using Rotspit for money transfers, cash equivalents, gift cards for resale, or anything other than buying a genuine gift.
- Fraud, using cards you are not authorised to use, or deliberately triggering chargebacks.
- Items that are illegal in the UAE or restricted by our retailers or payment partners.
- Harassment, impersonation, spam, scraping, or interfering with the service or its security.
10. Your content
You keep ownership of messages, photos and wishlist notes you post. You give Rotspit a licence to host and display them to the people you share them with, only to run the service.
11. Liability
Nothing in these terms limits rights you have under UAE consumer protection law. Subject to that, Rotspit is not liable for indirect or consequential loss, and our total liability for a gift is limited to the amounts charged for it. OWNER-ACTION: counsel to finalise the liability cap and exclusions.
12. Suspension and closing your account
We may suspend or close an account that breaks these terms, poses a fraud risk or is required to be closed by law. Holds on your pledges are released when your account is closed, except for gifts already charged, which we complete or refund.
13. Changes to these terms
We will tell you in the app before material changes take effect and ask you to accept them. Each version is numbered (for example 2026-09-v1) and we keep a record of which version you accepted.
14. Governing law and disputes
These terms are governed by the laws of the United Arab Emirates. OWNER-ACTION: courts or arbitral seat (onshore UAE courts, DIFC or ADGM) to be confirmed by counsel.
15. Contact
Questions about these terms: OWNER-ACTION: support email and postal address.
